SFCA Auction Bidder Contract 2025-26
This Bidder Contract (“Agreement”) is entered into by and between the undersigned Bidder (“Bidder”) and the Auctioneer or Auction Company (“Auctioneer”). By registering for and participating in this auction, Bidder acknowledges that he/she has read, understands, and agrees to be bound by the terms and conditions set forth herein. Additional terms may be announced prior to or during the auction and are incorporated herein by reference.
1. FULL PAYMENT: All purchases must be paid in full on the day of the auction before Bidder leaves the premises. No items may be removed until full payment has been received. Payment may be made in cash, cashier’s check, personal or business check (with proper identification and approval), or via online credit card transaction. Applicable Florida sales tax will be charged unless a valid resale certificate is provided. Bidder agrees not to stop payment on checks or reverse credit card transactions and is responsible for all fees, including legal and collection costs, incurred as a result of non-payment or returned checks. Auctioneer reserves the right to repossess items at any time, at the buyer’s location, in the event of non-payment.
2. NO WARRANTY: ALL ITEMS ARE SOLD “AS IS,” “WHERE IS,” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Descriptions provided in advertising or made verbally are believed to be accurate but are not guaranteed. Bidder is solely responsible for examining and assessing the condition of items prior to bidding.
3. DISPUTES: Auctioneer shall designate the winning bidder for each item. In the event of any dispute between two or more bidders, the Auctioneer may, at his/her sole discretion, reopen the bidding or declare a winner. The Auctioneer’s decision shall be final and binding on all parties.
4. BUYERS’ RESPONSIBILITY: Upon the Auctioneer’s designation of a winning bid, ownership of the item transfers to the Bidder. Bidder assumes full responsibility for the item(s), including the risk of loss or damage, regardless of payment or removal status. Bidder is responsible for securing and removing purchased items in a timely and safe manner.
5. INJURY & DAMAGE: Bidder agrees to indemnify and hold harmless the Auctioneer, its employees, agents, and the property owner from any and all claims for personal injury or property damage caused by the Bidder, their agents, or guests while on auction premises. Bidder enters the premises at their own risk.
6. AUCTIONEER’S AGENCY: The Auctioneer is acting solely as the agent for the Seller unless otherwise stated in writing. No partnership, joint venture, or agency relationship is implied between the Auctioneer and the Bidder.
7. BIDDER VERIFICATION: Auctioneer reserves the right to verify the identity and eligibility of all bidders and to refuse registration to any person for any reason. By registering, Bidder affirms they are at least 18 years of age and legally capable of entering into binding contracts.
8. COMPLIANCE WITH LAWS: Bidder agrees to comply with all applicable federal, state, and local laws, ordinances, and regulations in connection with participation in the auction and acquisition or use of purchased items.
9. LIMITATION OF LIABILITY: In no event shall Auctioneer be liable for any consequential, incidental, or indirect damages arising out of or in connection with the sale, use, or inability to use any items purchased.
10. ENTIRE AGREEMENT: This Agreement constitutes the entire understanding between the Bidder and Auctioneer with respect to the subject matter hereof and supersedes all prior oral or written agreements or understandings.
